You agree that you have read and understand this Policy by accessing or using www.Workfyx.com, the Workfyx mobile app, or any other associated sites, applications, services, and commodities, or any other website managed by Workfyx that links to this policy (each, the "Site"). We shall notify you of any major changes to this Policy by email or through a prominent notice on the Site, as well as taking any other actions necessary to comply with applicable law. Any revisions to this Policy will take effect as of the date of the most recent "Last Updated" version. It is your responsibility to check the Policy on a regular basis for any modifications or updates.


Clients, freelancers, and other visitors browsing the Site ("users"), as well as affiliates, influencers, and other collaborators working with Workfyx, can rest assured that their personal information will be safe with Workfyx and its related companies (including FyxNetwork). We think it's important for you to know how and why we use the data we collect about you when you use the Site. This Policy outlines how we treat the personal information of visitors to the Site and users of Workfyx's services, including our affiliates, influencers, and other collaborators who are individuals. You agree that you have read this Policy and understand how we collect, use, disclose, process, and retain personal information by accessing and/or using the Site and its related sites, applications, services, goods, and/or creating an account and/or creating an affiliate or influencer or similar program. This Policy also explains how to put restrictions on the spread of data.


Information We Collect


Information You Provide. We ask for information such as your name, email address, WorldX or Social Network login details and username when you register to use the Site, use the Site, fill out forms, participate in skills tests or surveys, use the Site as a collaborator, and/or register to our affiliate or influencer or similar program. In addition to the information listed above, we may also collect information such as your name, profile details, physical address or billing information, telephone number or other contact information, transactional information, payment information (for example, in certain cases we process your payment method and credit card number), taxpayer information and forms, information about other social network linked accounts, information about listed gigs, purchases, education, and profession, and information about other social networks linked accounts. We also save information that you provide to us when you contact Workfyx, post to our blogs or forums, or communicate with other users.


Information We Collect Automatically.


When you visit, browse, view, or otherwise interact with the Site, we gather certain information about you. In other words, when you use the Site, we record details about your visit, including the searches you conduct, the pages you see, and any purchases or communications you make. We also collect, utilize, and process information about your usage of the Site, such as your geographic location, Internet Protocol address, device and connection details, browser and connection details, web-log details, and the addresses of any pages you visited immediately before or immediately after using the Site. As you'll see below, we also gather and process data on your cookie and similar technology usage. In addition to providing our services to you, improving the user experience, and tailoring the content and layout of the Site to each individual visitor, we also use this data to monitor the Site for signs of fraud or other potentially harmful activity.


We have also added impression reporting to enhance your time spent on Workfyx.com. We collect information such as your Globally Unique Identifiable Number (GUID), HTTP request data (including user agent, IP, host, URL, requesting country/continent, browser info, device info, OS, and OS version), and more when you view our advertisements.


Information We Receive from Third Parties. Third-party suppliers and other commercially available sources provide us with data, such as:


  • In compliance with the law, we may use data from third-party suppliers to complement the information we gather about you. Providers often alert us to potential fraudulent activity, which helps with our overall fraud prevention and risk assessment efforts. We also work with advertising and marketing partners that provide us with data that helps us manage and evaluate our campaigns, as well as enrichment service providers who help us improve and personalize your experience.
  • We receive information, including your registration and profile data, from the third-party service you link, connect, or login with (e.g. Google, Facebook, LinkedIn). The service in question determines what data it collects and stores, or it collects and stores data only with your permission, based on the privacy settings you've established for that service.
  • If you invite people from your G-suite address book, we will be able to see their information if you have given us permission to do so. We'll use this information to send invitations to your connections so they can create an account on Workfyx. We will also use aggregated, anonymous data for our own analysis.
  • If you choose to add information from third parties to your account or combine your account with third party systems, tools, or products, we will get certain information about you in accordance with the permissions you have set up with those third parties.
  • If you are invited to Workfyx by another user, for example as part of our collaboration tools and referral program, we will receive limited information about you, such as your email address or other contact information, and we will use it for the same purpose it was provided and in accordance with the terms of this Privacy Policy.


For the purposes described in this Policy, we may combine your personal data with data we get automatically or from other sources.


Our Legal Basis for Using Your Personal Information


All processing of your personal information shall be based on a "lawful ground" for processing, as required by any applicable legislation. When doing processing, it will usually be okay to do so because:


  • your permission has been granted for us to utilize your personal data;
  • When we use your personal information, it's because we have to in order to fulfill our end of a bargain when you've asked us to (such delivering the services you've paid for);

How Do We Use The Information Collected?


Your data will be used for the following reasons:


  • in order to run the Site, fulfill our commitments to you, create new features for the service, and keep you safe while using them. We also utilize this data for account creation and maintenance, password verification and re-issue, activity tracking, member-to-member communication, technical assistance, and periodic communication. We may use your personal information for a variety of purposes, including but not limited to: enforcing our Terms of Service; conducting security investigations and risk assessments; verifying or authenticating information you provide; monitoring content integrity; and conducting security investigations and risk assessments. To accomplish these goals, we engage in certain behavioral analytics, and in some situations, automated systems may limit or suspend your access to Workfyx if we determine that your actions pose a threat to the Workfyx marketplace, other users, our community, or third parties.   • to get in touch with you in response to your specific inquiries or as otherwise approved by you or permitted by this Policy.
  • advertising and publicizing Workfyx, our services, and the Site to potential buyers and sellers. We may use the information we gather from you for a variety of purposes, including as responding to your requests for information, providing you with material that may be of interest to you, and arranging and carrying out contests, referral programs, and other forms of promotion.
  • to keep documents as required by law, to cooperate with legitimate inquiries from government agencies, and to follow all relevant rules and regulations.


If we want to use your data in a way that isn't covered by this Policy, we'll get your permission first.


Direct marketing:


  • We may use the information you provide about yourself to contact you directly with marketing material and information on Workfyx goods, services, and promotions that may be of interest to you. Online ads that are specifically tailored to the user's interests also fall into this category.
  • When we collect and use information about you for marketing purposes, we do so because we have a legitimate business need to do so, we have your consent to do so, or we are otherwise permitted to do so under applicable law. You have the right to stop receiving direct marketing at any time, and you can do so by clicking the "opt-out" link included in every marketing email you receive or by sending an email to optout@Workfyx.com.
  • We take precautions to keep direct marketing to a minimum, and we only send you messages that we think you'll find interesting or relevant based on the data we have collected about you.


How Long Do We Keep Personal Information?


As a general rule, we store individual data for no longer than is necessary to achieve the goals for which it was gathered. However, we may keep your information for longer periods of time in special conditions. For the following reasons, we will keep your information on file:


  • as long as it serves a purpose central to our business (such as documenting your transactions so we can refer back to them if necessary); and
  • for the purposes of complying with relevant laws, preventing fraud, collecting any payments owing, resolving disputes, troubleshooting difficulties, aiding any investigation, enforcing our Site rules, and any other steps permitted by law with regards to personal information from closed accounts.


Children


Only users who can make a legally enforceable agreement (i.e., those who have reached the age of majority in their country of residence) are eligible to use this Site. All users must be at least 13 years old, and anyone under 18 must have permission from a parent or legal guardian to use the Site. The Site and the Workfyx services are not available to anybody under the age of 13. Information from minors under the age of 13 is never intentionally collected. At all times, parents and guardians should keep an eye on their children. We will immediately erase any information that we have acquired or received from a kid under the age of 13. privacy@workfyx.com should be contacted if there is reason to suspect we might have any information from or about a child under the age of 13.


Sharing Personal Information with Third Parties


We will never share your information with a third party for their marketing purposes unless you give us permission to do so.


We disclose your personal data to outside parties in the ways described below:


  • Visitors and other users of the Site. Your username, country, and other details about your behavior on the Site are all public after you register. Your uploaded images, published portfolio, Gig details, ratings, and whatever else you choose to add to your profile. You can also use our public forums, blogs, and other tools to share your thoughts and opinions with the world. When you utilize these tools, some of your personal information, such your username and profile, may be made visible to the public. When you send a message to, or engage in any other sort of communication with, another user, that individual will also receive a copy of your profile. You do so at your own risk when you make your data public and/or share it with other users of Workfyx. Users, such as the Freelancers who are performing services for you through Workfyx, receive the personal information you choose to provide with them as independent controllers. It is your obligation to ensure that other users will comply with your standards, even if Workfyx's Terms of Service require Freelancers to keep the information shared with them confidential.
  • With Third-Party Suppliers. For business reasons, we may share your personal information with third-party service providers who help us run the Site, open and manage your account, and supply related services and solutions. IT SaaS services, session recording, communication systems, mailing systems, data optimization and marketing services, data enrichment services, legal and financial advisors or technical consultants are all examples of such providers. We take the necessary technological and organizational precautions to ensure that your personal information is protected and is only processed in line with our instructions, as required by applicable law;
  • For considerations of law. In response to a subpoena, court order, judicial process, or to regulatory authorities, we may disclose personal information to the appropriate government or law enforcement agency when we believe it is necessary or appropriate to do so (for example, in connection with an investigation into actual or suspected fraud or other illegal activity).

To ensure the Freelancer's services meet your needs, for instance, we may share limited information about you (such as the fact that this is your first purchase on Workfyx) with the Freelancer. This information sharing is strictly limited to improving the Freelancer's services and your overall user experience.
  • Together with our corporate partners. For the purposes of administering the Site, providing our services to you, and for the other purposes indicated herein, we share personal information with the corporate affiliates of Workfyx (FyxNetwork that are related by common control; and
  • Within the framework of a business deal. If Workfyx goes through a corporate transition, such as a merger, sale, transfer of all or a portion of its assets, acquisition, bankruptcy, or similar event, we may also be required to share your personal information. If we ever decide to sell the company or its assets, the new owner will have access to your information. Information we collect from users is an asset that could be sold or otherwise transferred in the event of a merger, acquisition, bankruptcy, or liquidation.


This Site is also protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply with respect to data collected by reCAPTCHA. We haven't looked into the adequacy of these policies and terms of service, and we don't manage them. Please read them carefully before providing any personal information.


Security


We employ standard security technology and internal policies to prevent unauthorized access, loss, misuse, alteration, destruction, or damage to the Site, our services, and your personal information. We are routinely audited and re-certified as compliant with the PCI DSS (Payment Card Industry Data Security Standards) for accepting credit card payments. In addition, we make it a point to contractually require the same level of protection for the privacy and security of your data from any third parties that may have access to it during the course of processing.   • We may collect the following types of information about you when you use Workfyx: (i) identifiers and personal information, such as online identifiers, IP addresses, access device and connection information, such as browser type, version, and time zone setting and browser plug-in types and versions; (ii) commercial information, such as products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies; and (iii) Internet or other electronic communications data. (iv) Data about a certain place.
  • Information that we collect or receive from third parties, including service providers, advertisers, and third-party accounts you link with Workfyx, including: (i) Identifiers and personal information, including name, online identifiers, email addresses, internet protocol (IP) addresses, access device and connection information, including browser type, version, and time zone setting and browser plug-in types and versions; (ii) Professional or employment-related information; and (iii)
  • Conclusions generated about you based on any of the aforementioned data.


Personal information is used for commercial purposes, such as those listed in the "How Do We Use the Information Collected?" section.


The kinds of personal information stated above may be shared with third parties for business purposes in the ways described above in the Section headed "Sharing Personal Information with Third Parties" of the Privacy Policy. We have shared all the above types of personal information for business reasons in the past twelve (12) months.


We do not "sell" personal information (as that term is defined by the CCPA) to other parties, as we have stated previously in this Policy.


Subject to certain exclusions, the CCPA grants you the following rights with respect to your personal information:

You are limited to two requests for access each calendar year. Any information we share with you will be limited to the most recent 12 months prior to the time we received your request. Verifiable User requests are processed and answered free of charge unless they are excessive, repetitive, or clearly baseless. Before proceeding with your request, we will let you know if there will be any fees associated with it and how much they will be.


Updating Personal Information


We take reasonable measures to maintain the accuracy and currency of your personal information, and we give you the option to do so via your account profile settings. Please let us know right away if you find any errors or inaccuracies in your information. Unless we are required to store data for valid business or legal reasons, we will conduct an immediate investigation into the situation and make any necessary corrections as soon as feasible. Before making any changes to your profile, we'll need you to prove your identity. Contact Workfyx's Customer Support if you have any trouble erasing your personal information, and we will use commercially reasonable measures to erase such information in accordance with applicable privacy regulations.


After signing into the Site, you can access your profile page to review and update your personal information.


A copy of your User Generated Content ("UGC"), as defined in the Workfyx Terms of Service, may remain viewable in cached and archived pages or may have been copied or retained by other Site users despite your efforts to erase it. Our Terms of Service outline the rules for accessing and using the content available on the Site, including User Generated Content.
